1. Introduction

Welcome to Postification ("we," "our," or "us"). Postification is a software-as-a-service (SaaS) platform that enables users to schedule and automate social media posts across various platforms, including X (formerly Twitter) and other social media services.

By accessing or using Postification, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our service. These Terms constitute a legally binding agreement between you and Postification.

We reserve the right to modify these Terms at any time. Your continued use of the service after any such changes constitutes your acceptance of the new Terms.

2. Eligibility

To use Postification, you must:

• Be at least 18 years of age, or the age of majority in your jurisdiction, whichever is higher
• Have the legal authority to enter into binding agreements
• Comply with all applicable laws and regulations in your jurisdiction
• Not be prohibited from using the service under applicable law

If you are using Postification on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

3. Account Registration

To use Postification, you must create an account by providing accurate, current, and complete information. You are responsible for:

• Maintaining the security and confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or use of your account
• Ensuring that all information provided to us remains accurate and up-to-date

We reserve the right to suspend or terminate your account at any time if we believe you have violated these Terms, engaged in fraudulent activity, or if your account poses a security risk to our service or other users.

You may not share your account credentials with third parties or use another user's account without permission.

4. Description of Service

Postification provides a web-based platform that allows users to:

• Schedule social media posts for future publication
• Upload and attach media (images, videos) to scheduled posts
• Manage multiple social media accounts
• View scheduled posts in a calendar interface
• Automate the publication of scheduled posts via automated systems (cron jobs)

Postification integrates with third-party social media platforms through their Application Programming Interfaces (APIs). We do not guarantee that:

• All scheduled posts will be successfully published
• Third-party APIs will be available, functional, or accessible at all times
• Posts will be published at the exact scheduled time
• Third-party platforms will accept or display your content

The service is provided "as is" and "as available" without warranties of any kind, either express or implied.

5. Social Media & Third-Party Integrations

Postification is not affiliated with, endorsed by, or sponsored by X (formerly Twitter), Instagram, LinkedIn, or any other social media platform. We are an independent service provider that uses publicly available APIs to facilitate content scheduling and publication.

By connecting your social media accounts to Postification, you:

• Grant us permission to access your social media accounts via their APIs
• Authorize us to publish content on your behalf according to your scheduled posts
• Acknowledge that we act as your agent in publishing content to third-party platforms
• Understand that you remain solely responsible for all content published through our service

We are not responsible for:

• API outages, failures, or changes implemented by third-party platforms
• Revocation of API access by third-party platforms
• Changes to API permissions, rate limits, or functionality
• Rejection, removal, or modification of your content by third-party platforms
• Any actions taken by third-party platforms against your accounts
• Loss of data or functionality due to third-party API changes

Third-party platforms may change their APIs, terms of service, or revoke access at any time without notice. We will make reasonable efforts to adapt to such changes but cannot guarantee continued functionality.

6. User Content & Responsibility

You retain all ownership rights to the content you create, upload, or schedule through Postification ("User Content"). By using our service, you represent and warrant that:

• You own or have the necessary rights, licenses, and permissions to use and authorize us to publish all User Content
• Your User Content does not infringe upon the intellectual property rights, privacy rights, or other rights of any third party
• Your User Content complies with all applicable laws and regulations
• Your User Content complies with the terms of service and community guidelines of all third-party platforms where it will be published
• You have obtained all necessary permissions for any media (images, videos) included in your posts

You are solely responsible for:

• The legality, accuracy, and appropriateness of all User Content
• Ensuring User Content does not violate copyright, trademark, or other intellectual property laws
• Complying with platform-specific rules, community guidelines, and terms of service
• Any consequences arising from the publication of User Content

We are not liable for any User Content published through our service. We do not review, monitor, or moderate User Content before publication, except as required by law or to prevent abuse of our service.

We reserve the right, but not the obligation, to remove or refuse to publish any User Content that we believe violates these Terms, applicable law, or third-party platform policies.

7. Prohibited Uses

You agree not to use Postification to:

• Publish, transmit, or distribute any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Violate any applicable local, state, national, or international law or regulation
• Infringe upon the intellectual property rights, privacy rights, or other rights of any third party
• Engage in spam, unsolicited bulk messaging, or any form of automated abuse
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity
• Violate the terms of service, community guidelines, or policies of any third-party social media platform
• Attempt to gain unauthorized access to our systems, networks, or other users' accounts
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of our service
• Use automated scripts, bots, or other means to access or interact with our service in ways that exceed normal usage patterns
• Interfere with or disrupt the integrity or performance of our service or third-party services
• Collect or harvest information about other users without their consent
• Use the service for any purpose that could damage, disable, or impair our service or interfere with any other party's use of the service

Violation of these prohibitions may result in immediate termination of your account and may subject you to legal liability.

8. Payments & Billing

Postification uses a one-time payment model. All plans require payment upfront and provide access to all features for the selected period (annual or lifetime, as specified at purchase).

Payment terms:

• All prices are displayed in the currency specified at the time of purchase
• We reserve the right to change our pricing at any time, but price changes will not affect existing paid subscriptions until renewal
• Payments are processed by third-party payment providers. We do not store or process your full payment card information
• You are responsible for any taxes, duties, or fees applicable to your purchase in your jurisdiction
• All payments are final unless otherwise required by applicable law

Refunds:

• We do not offer refunds for paid subscriptions except as required by applicable law
• If you are located in a jurisdiction that requires refund rights, those rights will apply as mandated by local law
• Refund requests must be submitted within the timeframe required by applicable law, if any

Chargebacks and payment disputes:

• If you initiate a chargeback or payment dispute, we reserve the right to immediately suspend or terminate your account
• We may dispute chargebacks and provide evidence of service delivery to payment processors
• Repeated chargebacks may result in permanent account termination

If payment fails or your subscription expires, your account access will be restricted, and you will need to purchase a new plan to regain access to dashboard features.

9. Availability & Uptime

Postification is provided "as is" and "as available" without any warranties or guarantees regarding:

• Uptime, availability, or uninterrupted access to the service
• Error-free operation or freedom from bugs, viruses, or other harmful components
• Accuracy, completeness, or reliability of any information provided through the service
• Successful delivery of scheduled posts
• Compatibility with all devices, browsers, or operating systems

We do not provide Service Level Agreements (SLAs) or uptime guarantees. The service may be unavailable due to:

• Scheduled maintenance or updates
• Unscheduled maintenance or technical issues
• Third-party service outages (hosting, APIs, payment processors)
• Force majeure events beyond our reasonable control

We will make reasonable efforts to minimize downtime and provide advance notice of scheduled maintenance when possible, but we are not obligated to do so.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Postification and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of revenue, profits, data, or business opportunities
• Missed or failed scheduled posts
• API failures or third-party service outages
• Loss of social media followers, engagement, or account access
• Data loss caused by third-party services or your actions
• Costs of procuring substitute services
• Any other damages arising from your use or inability to use the service

Our total liability to you for any claims arising from or related to the service shall not exceed the amount you paid to us for your current plan, or one hundred dollars (USD $100), whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you. In such cases, our liability will be limited to the maximum extent permitted by law.

We are not responsible for any actions taken by third-party platforms, including but not limited to account suspension, content removal, or API access revocation.

11. Indemnification

You agree to indemnify, defend, and hold harmless Postification and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the service
• Your User Content, including any claims that your content infringes upon the rights of third parties
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Your violation of any third-party rights, including intellectual property rights
• Your misuse of third-party APIs or violation of third-party platform terms of service
• Any actions taken by third parties as a result of content published through our service

This indemnification obligation will survive termination of these Terms and your use of the service.

12. Termination

We reserve the right to suspend or terminate your account and access to the service immediately, without prior notice, if:

• You violate these Terms or any applicable law
• You engage in fraudulent, abusive, or illegal activity
• Your use of the service poses a security risk to us or other users
• You fail to pay required fees (for paid plans)
• We are required to do so by law or at the request of law enforcement
• We discontinue the service or any portion thereof

You may terminate your account at any time by contacting us or using account deletion features, if available. Upon termination:

• Your right to use the service will immediately cease
• We may delete or retain your account data in accordance with our Privacy Policy
• Any scheduled posts may be cancelled
• You will not be entitled to any refunds unless required by applicable law

Sections of these Terms that by their nature should survive termination will survive, including but not limited to sections on Limitation of Liability, Indemnification, and Governing Law.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on this page with a new "Last updated" date
• Sending an email notification to the address associated with your account (for material changes)
• Displaying a notice within the service

Your continued use of the service after any changes to these Terms constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the service and may terminate your account.

We encourage you to review these Terms periodically to stay informed of any updates.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions.

Any disputes arising from or related to these Terms or the service shall be subject to the exclusive jurisdiction of the courts of Turkey. However, if you are a consumer located in the European Union, you may also be entitled to the protection of mandatory consumer protection laws in your country of residence.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
